The SEC has filed criminal complaints against five individuals for illicitly operating a digital asset business without a license. They offered Worldcoin trading and violated regulations. Caution is advised for investors.

The Securities and Exchange Commission (SEC) has lodged criminal complaints with the Economic Crime Suppression Division (ECD) against five individuals: (1) Ms. Sarida Jittaueafuea, (2) Mr. Mongkol Chantarach, (3) Mr. Piyamat Notee, (4) Ms. Natcha Rungkassattra (formerly Ms. Thidarat Rungkassattra), and (5) Ms. Taksaporn Kajornpap. They are accused of operating a digital asset trading business without the required license, in violation of the Emergency Decree on Digital Asset Businesses B.E. 2561 (2018).

The SEC discovered that five individuals were involved in providing Worldcoin (WLD) trading services, sharing related information in Thai via social media platforms, and presenting themselves as service providers outside authorized digital asset exchanges. These activities were conducted as part of their regular business operations and constitute the operation of a digital asset dealing business without a license. Such actions violate Section 26 of the Emergency Decree, in conjunction with Section 83 of the Criminal Code, and are subject to penalties under Section 66 of the Emergency Decree. Consequently, the SEC has filed criminal complaints against these individuals with the ECD for further legal proceedings.

Following
the criminal complaint filed by the SEC, the criminal enforcement process will
proceed with an investigation by the inquiry official, prosecution by the public prosecutor, and adjudication by the court of
justice, respectively. In this regard, the SEC will monitor the progress of the
legal proceedings and cooperate fully with relevant agencies to support legal
enforcement under the Emergency Decree after the criminal complaint has been
filed.
