BANGKOK, Oct. 31, 2026 — Thailand’s Securities and Exchange Commission (SEC) is seeking public comments on draft rules that would allow digital assets to serve as underlying assets for derivatives.
The proposals cover licensing requirements for derivatives exchanges, clearing houses and intermediary businesses. They would allow digital asset business operators to apply for derivatives licenses without setting up new companies, bringing the businesses under a unified regulatory framework.
The SEC has prepared eight draft notifications. They include changes to licensing criteria and revised financial reporting standards for derivatives exchanges and clearing houses, intended to strengthen oversight of market infrastructure.
The proposals follow a public hearing held from April to May 2026. The SEC said most stakeholders supported the principles and submitted additional suggestions.
The changes are intended to let investors use regulated derivatives referencing digital assets to manage portfolio risk, while aligning Thailand’s derivatives market with international standards.
The consultation is open until Nov. 28, 2026. Comments can be submitted through the SEC’s website or Thailand’s Legal Hub, or by email to the addresses listed in the SEC’s consultation notice.
